Terms of Use

These terms apply when you download or use Signature Maker: eSign & Form. Please read them, especially the sections on subscriptions and on electronic signatures.

1. Agreement

Signature Maker: eSign & Form (“eSign”, “the app”) is provided by Alina Bohuslavska, an independent developer (“we”, “us”). By downloading or using the app you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, please don’t use the app.

The app is licensed, not sold, to you through the Apple App Store. Your use is also subject to Apple’s Licensed Application End User License Agreement and the App Store’s usage rules. If these terms conflict with Apple’s, these terms apply to the extent permitted.

2. What eSign does

eSign lets you open documents and images on your device, add signatures, initials, text, dates, checkboxes and other marks, and export or share the result. Everything happens on your device; eSign does not send documents for signature, store them in the cloud, or verify anyone’s identity.

3. Electronic signatures

Electronic signatures are legally recognised in many countries and situations, but not all. Whether a signature made with eSign is valid or enforceable for a particular document depends on the law that applies to it and on what the other party accepts. eSign does not provide identity verification, certificate-based (“qualified” or “advanced”) signatures, or an audit trail.

You are responsible for deciding whether an electronic signature is appropriate for your document. Some documents, such as wills, certain property transfers, court filings or notarised papers, may require a handwritten or specially certified signature. eSign does not provide legal advice.

You may only sign with your own signature, or with someone else’s signature if you are legally authorised to sign on their behalf.

4. Free use and eSign Pro

You can use eSign for free with some limits, such as a limited number of exported documents. eSign Pro removes these limits and unlocks all features. Pro is offered as an auto-renewing subscription (for example weekly or yearly) and may also be offered as a one-time lifetime purchase. The available options, prices and any free trial are shown in the app before you buy and may differ by country.

Auto-renewing subscriptions

  • Payment is charged to your Apple ID account when you confirm the purchase, or when a free trial ends.
  • Subscriptions renew automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel a subscription at any time in Settings → your name → Subscriptions. Cancelling stops future renewals; you keep Pro until the end of the period you have paid for.
  • If you start a subscription during a free trial, any unused part of the trial ends when you buy.
  • If a price changes, Apple will notify you in advance as required, and you can cancel before the new price applies.

Refunds and restoring purchases

Purchases are processed by Apple, so refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. If you reinstall the app or switch devices, use “Restore Purchase” in Settings with the same Apple ID.

5. Your content

Documents, signatures and everything else you create in eSign belong to you. Because they are stored only on your device, we cannot see them, recover them or restore them if they are lost. Keep copies of important documents, for example by exporting them to Files or including your device in backups.

You are responsible for the documents you open, sign and share, and for having the right to use them.

6. Acceptable use

You agree not to use eSign to:

  • forge, falsify or alter documents, or sign as someone else without authority;
  • commit fraud or deceive anyone, or break any law;
  • infringe anyone else’s rights, including copyright and privacy; or
  • copy, modify, reverse-engineer or redistribute the app, or bypass its purchase checks, except where the law allows this despite these terms.

7. Our app

The app, its design, code, name and logo are owned by us and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as allowed by the App Store usage rules.

We may update, change or stop offering features. If we discontinue the app, we will not be responsible for paid periods already used, but this does not affect your rights with Apple.

8. Third-party services

The app relies on services from Apple, RevenueCat and PostHog, described in our Privacy Policy. Their own terms apply to their services. Opening or sharing a document with another app (such as Mail or Files) is governed by that app’s terms.

9. Disclaimer

eSign is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the app will be error-free or uninterrupted, that every file will convert perfectly (for example, spreadsheets, presentations and iWork files may open as a first-page snapshot), or that any signature will be accepted by a third party or a court.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, documents, profits or business, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

11. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of restricted parties.

12. Ending use

You can stop using eSign at any time by deleting it; remember to cancel any subscription separately. If you seriously breach these terms, your licence to use the app ends.

13. Changes to these terms

We may update these terms from time to time. We will post the new version here and update the “Last updated” date. If a change is significant, we will let you know in the app. By continuing to use eSign after a change, you accept the updated terms.

14. Governing law

These terms are governed by the laws of the country where the developer is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring claims in your local courts.
